Trainer Agreement and Terms of Service
Effective Date: April 10, 2026
Overview
Treniruoju.lt is an online marketplace that connects personal trainers with clients seeking fitness services. This Agreement governs your use of our platform as a trainer.
Key Point: You are an independent contractor, not an employee. The platform is a marketplace intermediary only.
Eligibility
To use Treniruoju.lt as a trainer, you must:
- Be at least 18 years old
- Have the legal right to work in Lithuania
- Possess valid professional certifications (fitness, nutrition, or related field)
- Hold professional liability insurance (or agree to obtain it)
- Comply with all Lithuanian laws and regulations
Professional Verification
Our verification process:
- You upload a copy of your ID and professional certifications
- Our team reviews your documents (typically within 5 business days)
- Upon approval, your profile displays a "Verified Trainer" badge
- Your verification status is subject to our Privacy Policy
⚠️ Important: Providing false credentials is grounds for immediate account suspension and potential legal action.
Professional Liability Insurance (Required)
You must:
- Maintain valid professional liability insurance at all times
- Provide proof of insurance upon request
- Will be suspended if insurance lapses
Minimum Recommended Coverage: €500,000 per claim (consult a Lithuanian insurance broker)
Your Responsibilities as a Trainer
Service Quality
- Provide safe, professional training services
- Follow fitness industry standards and best practices
- Obtain informed consent before training (especially for high-risk individuals)
- Refer clients to medical professionals if you suspect health issues
- Keep certificates and training methods up to date
Client Safety
- Conduct basic health screening (ask about injuries, medications, conditions)
- Provide warm-up and cool-down guidance
- Use proper, maintained equipment
- Never provide medical advice (refer to doctors)
- Stop immediately if a client experiences pain or distress
Legal Compliance
- Comply with Lithuanian labor laws and tax obligations
- Comply with GDPR when handling client health data
- Do not discriminate based on protected characteristics
- Report any concerns (abuse, fraud, safety) to authorities
Data Protection
- Obtain consent before collecting health or personal data
- Store client data securely
- Do not sell or share client data
- Delete client data upon request (unless legally required to retain)
- Treat all client information as confidential
Platform Policies
You agree to:
- Use the platform only for fitness services (no illegal activities)
- Not solicit clients to move off the platform (to bypass platform fees)
- Not create fake reviews or fraudulently rate yourself
- Not use the platform to harass, discriminate, or threaten clients
- Not share login credentials or transfer your account to others
- Not use bots or automated tools
- Respond to client messages within 24 hours (expected; not required)
Prohibited Conduct (Grounds for Suspension)
The following are strictly prohibited:
- Sexual harassment or coercion
- Discrimination (race, gender, disability, age, etc.)
- Physical abuse or assault
- Drug or alcohol use while training clients
- Theft or fraud
- False claims about qualifications or results
- Unauthorized collection or sale of personal data
- Defamation or false reviews
Consequence: Violation may result in immediate suspension and permanent ban.
Account Suspension and Termination
We May Suspend Your Account If:
- You violate this Agreement or platform policies
- You receive multiple complaints of unsafe or unprofessional conduct
- Your professional credentials expire or are revoked
- Your insurance lapses
- You fail to respond to compliance requests
Your Right to Appeal:
You have 14 days to appeal a suspension or termination. Email info@treniruoju.lt with your appeal and supporting evidence. We will review and respond within 7 days.
Fees and Payment
- You are responsible for: Paying your own taxes and social contributions
- Invoice format: May be required by Lithuanian law
- Record keeping: Keep records of earnings for tax purposes
- Tax reporting: Report income to Lithuanian tax authorities
Liability
- Platform Liability: We are a marketplace intermediary only. We are not liable for the quality or safety of training services you provide.
- Your Liability: You are solely responsible for the services you provide and must maintain professional liability insurance.
GDPR and Data Protection
You as a Data Controller
When you collect client health or personal data, you are a data controller and must:
- Obtain written consent before processing special categories of data (health info)
- Provide a privacy notice to clients
- Comply with GDPR Articles 12-22 (user rights)
Example: Handling Client Health Data
If a client tells you "I have a torn ACL; is this safe," that's health data. You must:
- Tell the client how you'll store it
- Delete it after your training ends
- Not share it with others
- Refer them to a doctor if injured
Dispute Resolution
If you have complaints or disputes:
- Email info@treniruoju.lt
- We respond within 5 business days
- If unresolved, either party may request binding arbitration
- Arbitration costs split equally
Governing Law
This Agreement is governed by Lithuanian civil law, EU GDPR, and European data protection directives. Disputes are resolved in Lithuanian courts (or arbitration).
